FINE PRINT: TERMS AND CONDITIONS

• Geographical Restriction: The Vehicle is not allowed to be driven or taken out of the UAE.
• Unauthorised Driver: The Renter is liable for all damages and costs to the vehicle caused by a driver not named in this agreement, even if the renter has purchased CDW.
• Toll charges and Tickets: The Renter agrees to pay all parking tickets, traffic violations and toll charges (5 aed per crossing) and will be liable for a service charge of 50 AED for each ticket or violation.
• Adherence to Local Laws: The Renter and any authorised driver/s must adhere to UAE’s laws regarding holding of a valid driving licence and residency, tourist visa and corresponding driving licence, at all times, while in possession of the Vehicle. Revv Road Car Rental reserves the right to repossess the Vehicle, forfeit any payments and terminate the agreement, should the Renter fail to provide these documents at Revv Road Car Rental request.
• Payment Consent: if payment has to be paid by credit or debit card, the renter’s digital or in-person signature on this agreement shall constitute authority and consent to debit his/her nominated card company, with all the charges related to this transaction, which include but not limited to rental charges, toll-fees, traffic violation fines, damage liability, administration charges, fuel charges and any other charges attributable to this Agreement. The Renter accepts and consents that all attributable charges to this rental Agreement may be debited to their credit or debit card at any time during the rental period and even after the Vehicle has been returned or the Agreement has finished if there are any outstanding charges.
• Cancellation and Early-Termination: For every 12 months, a charge of (1) months rental rate is applicable.
• Damages: Vehicle damages that are not reportable to the insurance company will be chargeable. The charges applied will be standard rates based on the damage.
• Service Schedule: It is the Renter’s responsibility to advise Revv Road Car Rental when a service is due and the car has reached the required kilometres..
• Fuel Usage: Car has to be returned with the same fuel tank level as when it was received. Any difference will be charged at a cost plus admin fee. Refer to the check out form for fuel details (you will receive this when you get the car).
• At Fault Deductible:  Deductible amounts are to be charged to the Renter (if CDW is not selected) and are applicable for all at-fault accidents, windscreen and tires damage due to  accident, OR if at-fault party is not present. A deductible of 1500 is charged for all economy vehicles. For all drivers under 25 or drivers with licences that were issued less than 12 months prior to this rental date, the driver is liable for 10% of the total accident cost in addition to the above mentioned deductible amounts. This condition is applicable whether the driver is at fault or not.
• Off Road Driving: Off Road driving is not covered by the insurance, and any damages incurred remain the liability of the Renter. Mechanical damages and wear and tear due to off road driving also remain the liability of the Renter.
• Termination: Revv Road Car Rental may at their own discretion terminate this contract at any point in time.

GENERAL TERMS AND CONDITIONS

1. DEFINITIONS AND INTERPRETATION

In this Agreement, the following words, unless the contract otherwise requires, shall have the following meaning.

• Revv Road Car Rental: refers to Revv Road Car Rental L.L.C, a company duly registered in the UAE.
• The Renter: refers to the natural person or entity who has agreed to rent a vehicle as mentioned in this Agreement according to the terms set forth herewith
• Vehicle: refers to vehicle more fully described in Schedule A of this Agreement
• UAE: means the United Arab Emirates

2. VEHICLE HIRE

The Renter agrees to rent the vehicle more fully described in Schedule A of this Agreement. Revv Road Car Rental is willing to lease the Vehicle to the Renter on the Terms and Conditions as set out in this Agreement.

3. PAYMENTS

• The Renter shall make payments to Revv Road Car Rental for the rented Vehicle, in accordance with the rates specified in Schedule A of this Agreement (“Payments”). Payments shall accrue from the date on which the Vehicle is delivered to the Renter, and shall continue until the completion of the Term (as defined in Schedule A) OR as long as the Renter has possession of the Vehicle.
• The first payment shall be made in advance of the rental date for the first month rental period, and thereafter shall be made 5 days in advance of each subsequent  monthly rental date.
• The Renter shall make the Security Deposit (as defined in Schedule A) and the Payments to Revv Road Car Rental by:
  • Credit / Debit Cards online through Stripe
• If the Renter fails to make the Payment before the due date, the renter will have (5) day grace period to make the Payment (the “Grace Period”). The Renter will be required to pay an additional 250 AED on top of the monthly rental fee if the Renter fails to pay the amount due during the Grace Period.
• If the Renter exceeds the mileage allocation set out in Schedule A, the Renter shall pay an excess mileage charge in accordance with Schedule A.
• The Renter shall be liable for all traffic, municipality  and any other violations incurred during when they have the Vehicle, and pay for any additional costs incurred whilst the Renter has the vehicle.
• Revv Road Car Rental shall send an invoice to the Renter each month for any charges incurred. The Renter must settle these invoices within 3 days of receiving the invoice.
• The Renter confirms, allows and authorises Revv Road Car Rental to charge all the costs set out in thiS Agreement from the Renters credit card without prior approval or authorisation.

4. DELIVERY, CONTRACT TERM AND RENEWAL

Revv Road Car Rental shall deliver the Vehicle to the Renter on a mutually agreed time and place, unless agreed or stated otherwise, this Agreement shall begin on the date of delivery of the Vehicle to the Renter and shall continue for the period specified in Schedule A unless the Vehicle has not been handed back to Revv Road Car Rental, then this Agreement stands until the Vehicle has be handed back and all charges have been cleared.

The Renter may renew the Agreement once completed if they wish to continue with Revv Road Car Rental.

5. VEHICLE OWNERSHIP

The Vehicle at all times shall remain the property of Revv Road Car Rental, and the Renter shall have no right, title or interest in or to the Vehicle, except the right to possess and use the Vehicle subject to the Terms and Conditions of this Agreement.

6. REGISTRATION

During the Term of this Agreement, and at Revv Road Car Rental expense, the Vehicle shall be registered in Revv Road Car Rental name and be licensed in accordance with the laws and regulations of the UAE.

7. INSURANCE

• Subject to Clause 7. Revv Road Car Rental shall at its own expense provide comprehensive insurance coverage for the Vehicle, (“Insurance”). The Renter shall comply with all the Terms and Conditions of the Vehicle as stated in this Agreement.
• The insurance shall not cover the contents in the car, this is the sole responsibility of the Renter
• During the Term of the Agreement, the Renter shall not be covered by the vehicle insurance in the following instances.
  • The person driving the Vehicle is not an Authorised Driver (defined below)
  • The Authorised Driver does not hold a valid UAE / GCC or eligible international drivers licence, in accordance with the rules set out by UAE regulators.
  • The Renter sub-lets the Vehicle
  • The Vehicle is used for carrying persons or property for hire
  • The Vehicle is used for propelling, off roading or towing away any vehicle or object in any test, race contest, or competition
  • The Vehicle is used in violation of any traffic, customs, or other regulations in the  Emirate of Dubai and applicable federal laws of the UAE
  • The Vehicle is driven by a driver under the influence of alcohol, drugs, narcotics or any other substance impairing the driver’s consciousness or ability to react.
    • Resulting from any of the instances set out above, the Renter shall pay Revv Road Car Rental for any:
      • Damages to the Vehicle
      • Third party expenses
      • Fines
      • Loss of revenue for the Vehicle whilst its under repair
      • Value of the Vehicle as specified by Revv Road Car Rental
      • An additional ten per cent (10%) of the claim is payable to Revv Road Car Rental if the driver is under twenty five (25) years of age and / or for drivers with a licence that were issued less than 12 months prior to the rental date, in accordance with the Ministry of Economy and Commerce, Circular dated 24/06/1996 for any damage to the Vehicle, whether the driver is at fault or not.

8. ACCIDENT 

• In the event of any accident or damage to the Vehicle, a police report must be obtained. If a police report is not obtained, the Renter will be responsible for obtaining the commission from the police in order to carry out the repairs. The Renter will also be responsible for the cost of repairing all damage incurred, and for all other liabilities and costs associated with the Vehicle and any costs incurred due to the accident subject to Clause 7.
• In the event of the total loss of the Vehicle, a police report must be obtained. If the report is not obtained, the Renter will be responsible for any damage incurred and for all the liabilities and all the associated costs which may have been caused or incurred, including the cost of the total loss of the vehicle as per the insurance company’ policy.
• If the accident is not the Renters fault, Revv Road Car Rental shall provide a replacement Vehicle as long as the monthly payments for the Agreement continue in accordance with Clause 3 of this Agreement.
• Accidents that are not reportable to the insurance will be chargeable. The charges applied will be standard rates based on the damage.

9. DRIVER REQUIREMENTS

• The Renter warrants and undertakes that the Vehicle shall only be driven by the Renter unless the Renter provides Revv Road Car Rental with a list of additional drivers who will be Driving the Vehicle (“Authorised Drivers”). The Renter should provide a list of additional drivers prior to this agreement for approval with all the necessary documentation.
• Each Authorised Driver must satisfy the following criteria
  • Be twenty five (25) years of age
  • Be within the renters IMMEDIATE FAMILY (husband, wife, children).
  • Hold a valid UAE Residency Visa or Active Tourist Visa and corresponding valid UAE, GCC, or international drivers licence that is accepted by Revv Road Car Rental. The Driver's licence must have been active for at least one calendar year (12 months).
  • AND have written approval from Revv Road Car Rental confirming that the additional driver is permitted to drive the Vehicle as mentioned in Schedule A of this Agreement.
  • The Renter undertakes that each Authorised Driver shall hold an original copy of their valid UAE, GCC or eligible international driving licence at all times while driving the Vehicle.

10. REPAIR AND MAINTENANCE

• Revv Road Car Rental shall provide full maintenance, repairs and servicing of the Vehicle in accordance with the Schedule A.
• Specified service intervals only where such servicing is required due to normal wear and tear. For the avoidance of doubt, any damage not due to normal wear and tear shall be paid for by the Renter.
• The Renter will make the Vehicle available to Revv Road Car Rental for regular servicing and maintenance at its workshop facilities by pre-arranged appointments. The Renter shall be responsible for any additional costs for servicing and/or repairs required as a result of any drivers negligence. The Renter shall be required to pay the additional charges prior to any repair and these charges may be charged to the Renters Credit Card without any additional approval from the Renter.
• Any damage to the tyres resulting in negligence will be treated as an accident in accordance with Clause 7 and 8.
• The Renter is responsible for ensuring that the oil, water and other fluid levels and the tyre pressures are regularly checked and maintained. Damages due to the Renters negligence, the Renter will be responsible for all costs relating to such repairs.
• The Renter shall not under any circumstance, repair, remove or replace any part, accessory or equipment of the Vehicle nor change the colour or allow any modification, alteration or repair of the vehicle.

11. REPLACEMENT VEHICLE

• Revv Road Car Rental will provide a basic replacement vehicle for the duration of any maintenance, servicing and repairs to the Vehicle if the option is applied to your circumstances under this Agreement. 
• A replacement vehicle for any damaged Vehicle will only be supplied following a police report where the Renter is not at fault.
• In the event that the Vehicle being rendered is totally unfit for use, Revv Road Car Rental, shall, at its discretion, either
  • Provide the Renter with a replacement vehicle
  • Issue a credit note (if applicable) or
  • Release the Renter from its payment obligations under this
• No replacement vehicle shall be provided for repairs and maintenance if this is due to the Renters negligence under Clause 10.

12. RENTERS OBLIGATIONS

The Renter shall:

• Ensure that all information, including but not limited to salary and bank account information,  are accurate and valid and shall undertake to notify Revv Road Car Rental if any such information previously provided information changes.
• Take good care of and properly maintain the Vehicle at all times.
• Promptly pay all fees, SALIK (toll) charges, traffic fines, dues for excess usage, damages, early termination charges,  or any other fees or changes owed to Revv Road Car Rental.
• Not conduct any illegal activities using or in the Vehicle.
• Not permit anyone other than the approved Drivers to drive the car by Revv Road Car Rental.
• Not drive the Vehicle outside the UAE.
• Only use the Vehicle exclusively for passenger transportation and shall not use it to sublet, or loan it to anyone for any commercial use, or other purpose whatsoever.
• Ensure that the Vehicle is not used in any manner that may void the warranty.
• Not place any identification marks on the Vehicle.
• Inform Revv Road Car Rental as soon as possible once an accident has occurred, any vehicle damage, car breakdown and provide the relevant police report where applicable.
• Comply with all traffic and other laws at all times when using the Vehicle.
• Ensure that the Renter holds a valid UAE Residency Visa or Active Tourist Visa AND corresponding valid UAE, GCC or eligible international drivers licence, all all times while using the Vehicle AND 
• Comply with all the Renters Obligations under this Agreement.

13. EARLY TERMINATION

Notwithstanding the Agreement and Term. The Renter may terminate the Agreement on the following conditions

• If the Agreement is terminated before completion of the tenure, the renter is required to pay Revv Road Car Rental an additional payment as per Schedule A.
• Revv Road Car Rental may terminate this Agreement at any time prior to the end of the Agreement Term where:
  • In Revv Road Car Rental sole opinion the Renter is in breach of any of its obligations, including but not limited to proper care and use of the Vehicle or the Renter’s payment obligations.
  • The Renter no longer meets the required criteria for this agreement

The Renter acknowledges that any breach of any of the Terms and Conditions under this Agreement may result in Revv Road Car Rental repossessing the Vehicle without prior notice.

14.TERMINATION

• Revv Road Car Rental may terminate this Agreement and repossess the Vehicle if the Renter fails to make a payment by the due date.
• Revv Road Car Rental is entitled to apply the Security Deposit and charge the Renters credit card against any default, loss or damage incurred by the Renter as set forth in this Agreement without prior approval from the Renter.
• The Renter and Authorised Driver/s must adhere to UAE’s laws regarding holding of a valid visa, residency and driver's licence at all times, while in possession of the Vehicle. Revv Road Car Rental reserves the right to repossess the vehicle, forfeit any payments and terminate the Agreement, should the Renter fail to provide these documents. Revv Road Car Rental repossessing of the Vehicle due to this reason shall NOT indemnify the Renter against any payments and liabilities due, as set out in this Agreement.

15. INDEMNITY

The Renter shall accept full indemnity against all losses including loss of profits, costs, expenses, claims, proceedings, damages and all other liabilities suffered or incurred by Revv Road Car Rental, directly or indirectly as a result of but not limited to:

• A breach of or failure to comply with the Renters duties under this Agreement or any other terms and conditions of this Agreement
• The imposition of any SALIK / toll charges, fines or penalties for Traffic law violations or other legal violations including drunken driving and other traffic offences whether or not the Renter was driving the Vehicle at the time such violation was incurred
• Any damage to the Vehicle unless a police report was obtained and submitted
• Any additional insurance premiums or claims
• The impoundment or confiscation of the Vehicle by any competent authority in connection with any of the matters referred to above or for any other reason within the control of the Renter
• Any act or omission on the part of the Renter, the Authorised Drivers, its agents or employees to the extent not covered by the Agreement.

16. NOTICES

• Any notice given to a party under or in connection with this Agreement shall be in writing and shall be given by hand or via email.
• Notice given by Revv Road Car Rental shall be deemed effective on the date received if personally delivered or sent by email.

17. FORCE MAJEURE

Revv Road Car Rental shall not be liable for any delays or failure to perform its obligations due to causes beyonds its reasonable control, including but not limited to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, diseases, failure or delays in materials or other supplier failures, delays or defaults by third parties (“Force Majeure Event”). For the duration of the Force Majeure event, Revv Road Car Rental obligations shall be suspended, provided that Revv Road Car Rental uses all reasonable endeavours to continue to perform or to resume the performance of its obligations during the Force Majeure Event.

18. WATER DAMAGE

Claims will be dealt with as per regulatory insurance policy. The Renter agrees to take the necessary  precautions and avoid driving the Vehicle into water or flooded areas. The Renter may be liable for the cost of damage and/or Vehicle should the insurance provider reject the claim. If the Vehicle has been exposed  to water / flood. The Renter should not start the engine and inform Revv Road Car Rental  immediately for necessary assistance. 

19. DEDUCTIBLE

A deductible is applicable if the renter does not have the CDW cover and is involved in a at fault accident, the deductible amount is provided in the Agreement in Schedule A.

20. TAX

Any payment, security deposit and any other fee payable by the Renter to Revv Road Car Rental are exclusive of value added tax and any other applicable taxes, duties or similar charges which shall be payable by the Renter at the rate and in the manner prescribed by law from time to time.

21. ENTIRE AGREEMENT

This Agreement  (including its schedules) constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between the parties, whether written or oral, relating to this subject matter.

22. VARIATION

No variation of this Agreement shall be effective unless it is in writing and signed by the parties (or their authorised representatives).

23. COUNTERPARTS

• This Agreement may be executed in any number of counterparts, each of which when executed shall constitute a duplicate original, but all the counterparts shall together constitute one Agreement.
• No counterpart shall be effective until each party has executed at least one.

24. GOVERNING LAW AND JURISDICTION

The Agreement shall be governed by and interpreted under the laws of the Emirates of Dubai and applicable federal laws of the UAE, and the parties shall submit to the exclusive jurisdiction of the courts of Dubai.
